Board of Works & Safety – August 3, 2021

The Board of Works and Safety for the City of Attica met, pursuant to Public Notice, on Tuesday, August 3rd, 2021, at 5:00 P.M. in the City Council Room.

Present was Board Members, Andy Smart, Chris Gayler, Mayor Duane Roderick, Attorney Mallory Redlin and Clerk-Treasurer Joanne Broadwater.

Minutes from the previous meeting: 

Gayler made a motion to approve the minutes from the July 20th, 2021, meeting, Smart seconded, all were in favor, and the motion passed.

Citizens petitions:

  • Melissa and David Lanham – 428 E. Main St. Attica, they are concerned regarding property lines with 430 E. Main St. property owned by John Smith. Ms. Lanham provided property documents to the Board. They disagree with John Smith over where the property line is, a survey has not been completed. The BOW advised the property owners that this is a civil dispute and that they would need a survey to resolve the issue. Roderick recommended the garage construction should be halted until a survey can be completed. The Lanham’s and Mr. Smith agree to obtain a survey.

Department Head Reports:

Director of Public Works, Eric Swank had nothing to report.

Attica Fire Chief, Mike Little gave a recap of the Fire Territory that is under consideration.

Police Chief, Matt Powell, was not present.

Building Commissioner, Jeff Pycke

The regular meeting was suspended to hold unsafe building order hearings.

  • 430 E. Main St. – Owned by John Smith, Pycke reported no work has been completed. Smith confirmed. Redlin asked what the plan for the property is, Smith gave an update and stated some work would be completed by the next BOW meeting. Roderick recommended that a review hearing be scheduled for September 7th, 2021, the board agreed.
  • 206 W. Pike St. – Ms. Parris – John Smith is purchasing the property; Smith gave an update on the property title issue with Medicaid. Smith also said he has done some work on the property. Roderick recommended this property be set for a review hearing September 7th, 2021; the board agreed.
  • 404 S. Perry St. – Zach Cooper owner, Pycke reported the property meets the requirements of the UBO. Broadwater stated there is a $500 fine previously assessed, and Swank stated there is also an outstanding bill for city cleanup. Smart made a motion to not release the UBO until the liens and other charges have been paid, Gayler seconded, all were in favor, motion passed.
  • 804 S. Brady St. – Smart stated that the contract buyers have moved out, and the property has been abandoned, no work has been done.  The board stated the property will be set for a review hearing on September 7th, 2021, and if no progress has been made a $5000 fine will be assessed.

The regular meeting was resumed.

Economic Development Director, Rod Bannon, was not present.

Gayler made a motion to approve disconnects, Smart seconded, motion passed.

The claims were presented by Mayor Roderick, Smart made a motion to approve claims, Gayler seconded.  All were in favor and the motion passed.

There being no further business, Gayler made a motion to adjourn, Smart seconded, the meeting was adjourned. The next Board of Works meeting will be held on Tuesday August 17th, 2021, at 5:00pm, in person, in the City Council meeting room.
